仅凭自己的智能手机，人们就能解锁这种共享单车。这些单车都装有全球定位系统，可以被放在公共场合的任何地方，等待下一位用户使用。它们受到了许多中国人的欢迎，因为它们有效地解决了“最后一公里”难题，即个人行程中的最后一段。

“在地铁线路覆盖不到的地方，很难换乘其他交通，用摩拜单车去你想去的地方就简单多了，”29岁的胡红(音译)在接受法新社采访时表示。在上海从事房地产行业的她都是骑自行车去上班的。

然而，这一计划也出现了一些问题，如非法停车，故意破坏和偷窃等。

上个月，北京的两名护士因在共享单车上上锁(占为己有)，被处以行政拘留5天。

而在去年12月，一名男子因偷窃一辆共享单车，被上海闵行人民法院判处拘役3个月，缓刑3个月，并处罚金人民币一千元。

“共享单车是种更加绿色的出行方式，并且为用户提供了一种友好的体验，”交通部副部长刘小明表示。“但是这是一种线上和线下商业的结合。经营者的线上业务能力很强，但缺乏线下业务经验，导致了问题产生。”

事实上，这些问题在国外的共享单车体系中也同样存在。创建于2007年的Vélib是一个位于巴黎的大型公共单车共享系统。在其初期的运营中，它也曾遭遇故意损毁及偷窃等问题。

据《纽约时报》报道，截至2009年10月，由于故意损毁和偷窃问题，大量初期的Vélib自行车不得不被置换。这些自行车曾被发现挂在街灯柱上，或是被扔进了塞纳河中。

为了处理这些问题，该公司想到一个办法：鼓励人们将自行车归还至站点，并在他们下次使用时奖励免费用车时间。

现在，中国的服务经营者们也开始尝试去解决这些问题。举个例子，摩拜单车为每个用户设定了100分的信用值，行为不当将会被扣分。当信用值降到80分以下时，自行车租赁费用将会从每30分钟0.5-1元上涨到100元。

纵观人类文明的历史长河，不论是春秋时期三次进谏蔡桓公的扁鹊，还是希腊被尊称为“医学之父”的希波克拉底。自千年前懂得使用药材救治他人的时候始，医生这个职业便产生了，并在漫长的时光中从未消失或被取代。

被尊称为“炎帝”的神农氏，看到被病痛折磨地苦不堪言的人们，毅然决然地去品尝百草。他在这一过程中不仅发现了许多对疾病有效的药物，还发现了不少粮食谷物，为人类的生存做出了伟大贡献。他也曾遇到过不能食用的植物，多次面临生命危险，但他从来没有停止探索的脚步。尽管这只是个神话，但我们依旧能从这口耳相传的故事中感受到神农氏为了救治他人奋不顾身的忘我精神。

抗日战争时期，伟大的加拿大共产党员白求恩同志于1938年1月2日来到正弥漫着硝烟的中国。一年半的时间里，他担任晋察冀军区卫生顾问，率医疗队到山西雁北和冀中前线进行战地救治。四个月的时间，行程750千米，手术300余次，建立手术室和包扎所13处，挽救了无数战士的生命。

_曾称他是一个高尚的人、一个纯粹的人、一个有道德的人、一个脱离了低级趣味的人、一个有益于人民的人。1938年，加拿大政府还未向德军宣战，而中国的战争早已打响。白求恩同志前往纽约向国际援华委员会报名，并主动请求组建一个医疗队到中国北部和游击队一同工作。他如此迫切地要前往中国，不只因为他是一名共产党员，更因为他是一名医护工作者，一位身穿白衣的医生。

时至今日，新的病毒还是层出不穷，医护工作者也从未停止与病魔的斗争。如今的新型冠状病毒，自武汉起大幅扩撒，有谁还记得封城的那天晚上，那些迎着人群，逆流而上的白衣战士，他们也像所有人一样担心病毒，惦念亲友。但他们嘴里说着“请命”，便身体力行地率先冲到武汉。

一时间，那一颗颗凡人的心被一袭白衣包裹，白衣瞬间化作铠甲，让身着它的勇士充满的无限的力量。他们在那一刻，已经无暇顾念自己的亲人朋友，满心都是那些被病痛折磨的患者，每天都迎接着新的挑战，不言辛苦疲惫，不顾自身安危，只因为那一袭白衣。

医护工作者的精神是大部分普通人无法理解的。他们的家朋友都在担心，但只有他们自己明白。这就是白衣承载的前辈嘱托，这就是身穿白衣者的责任担当，这就是普通人无法承受的白衣的分量。

翩翩白衣，孜孜战疫;临危受命，保国安民!

近日，“河南大学生家门口掏鸟窝获刑10年半”一事，经媒体报道后引起社会广泛关注。记者获悉，河南省高院已经介入此案，对其判决正在进行专题研究。(12月3日《法制晚报》)

掏鸟窝+获刑十年半，如此组合，话题性自然可想而知。有人很自然地搬出了那些动辄贪污上千万，却只获刑数年或是十余年的情况来加以类比，于是得出了人不如鸟、法院小题大做的结论，更有“情怀者”认为，因为几只鸟毁掉几个年轻人的前途，自然是不值得的。

事实上，如果撇开当事人大学生身份，类似的“鸟不如人”的判例并不少见，比如河南耍猴艺人被判刑、常州男子抓百只青蛙被起诉、温州民工抓三百只麻雀被刑拘。无论是学生也好，艺人也罢，或是民工，之所以会种下如此苦果，至少在法律上是有根有据的。在我国刑法以及最高人民法院关于审理破坏野生动物资源刑事案件具体应用法律若干问题的解释中，是能够为这些判例找到法理基础的。

事实上，拿贪官获刑来类比，是很好辩驳的，贪官获刑起点设置，本身就备受诟病，是亟需修正，拿一个本身就存在病态的事物来类比，这不是要比坏吗?更值得关注的是，法理依据念兹在兹，为何还会有人对这些判例觉得错愕甚至不能接受呢?以此事件为例，正如有论者所言，对公众来说，抓到十几只鸟卖出一千多块钱，就要入狱十年半?这种行为与后果之间的落差是寻常观念所难以接受的。

而之所以心生如此疑虑，原因又在于二：首先是对案情的有偏向地获取，比如简单地理解为“抓了几只鸟”，然后再在先入为主的影响下，搬出“保护野生动物的价值认可度并不高”的托词。但实际情况是，这个大学生并非一时顽劣，而是对所抓的鸟有清晰的了解，并且参与到捕猎、收购、倒卖整个环节中，据说他还是“河南鹰猎兴趣交流群”的一员。换句话说，这个大学生的“抓鸟”行为，从最朴素的原始情感出发，这至少不是值得原谅的无心之举。

而再回到现代法治社会的语境之下，保护野生动物的意识或许是个普遍存在的问题，但是，当我们以立法之名，对野生动物进行保护时，无论是从法律实施目标，还是从法律精神的层面来讲，所要恪守的应该是严厉的“罪刑法定”原则。既然刑法中已经对破坏野生动物做出了罪行设置，那么刑法的威严就应得到最大程度的尊重，用法律专业术语说，也就是刑罚的确定性。

当然，当我们热烈地强调让“道德归道德，法律归法律”，但这并不妨碍我们对法律宽严相济和谦抑性的热忱欢迎。事实上，“一律入刑”，并非不容分说的一刀切，它可以在法定刑责的基础上，根据事实和证据，讲梯度、分轻重、论区别，真正实现罪行责的相适应。

如果大学生“抓鸟入刑十年”，这种抓到一个算一个的威慑建构，在现阶段让人难以接受，那也是我们不得不接受的普法之重。在法律之威严面前，断然是不能以保护意识不强、公众心理上难以接受来“法外开恩”。它最终不仅无益于野生动物的保护，更是对法治文明的亵渎。

“自信是成功的第一秘诀”，正如美国的著名哲学家爱默生所说，要想成功，第一秘诀便是“自信”。

记得那是五年级上学期的期末考试前夕，我感到非常焦虑，总感觉这次考试就凭自己的水平肯定考不好，真的是信心全无。考试当天，监考老师发下了卷子，我状态不佳，浑浑噩噩地做完了这张卷子。

考试成绩出来了，当老师报到我的名字及分数时，果然，这次考试考砸了。回家后，我伤心地对爸爸说:“爸，考试题目好难啊，我就知道这次肯定会考砸。”爸爸安慰道:“鼎鼎啊 ，你怎么能对自己没有信心呢，不管做什么事都应该对自己有信心才对。对自己都没有信心了，怎会做好事情呢？”听了爸爸的话后，我恍然大悟，明白了自信的重要性。

不久后，我又迎来了五年级的英语阅读竞赛，这次我没有对自己失去信心，而是信心百倍地迎接这次考试。每天我都复习书本知识，并做一些相关的竞赛试题。阅读竞赛考试开始了，我自信地接过了试卷，先自信地浏览了整张试卷，感觉难度不大。接着，我便开始专心地答题，最后，我还细心地复查了整张卷子。第二天，考试的成绩出来了，我这次果然没有考砸，考出了我的真实水平，全班第二名。有了这次经历，我更加明白了自信的重要性。

同学们，自信很重要。成功需要自信！从今往后，我一定自信地去做好每一件事！
